Claim for Workers Compensation Benefits Turned Down

Claim for Workers Compensation Benefits Turned Down

Claim for Workers Compensation Benefits Turned Down: No one advocates abusing alcohol or drugs (legal or illegal), and if you suffer a work related injury because of the effects of drugs or alcohol, then you will not be entitled to workers compensation benefits.

Having stated this, just because a post injury drug screen showed the presence of alcohol or drugs does not mean that you are not entitled to workers compensation benefits, and in fact, in the majority of these type cases we have dealt with, the injured worker prevailed and was able to obtain all the benefits the law allows. This is because in Alabama, the job injury has to be caused by the injured employee being under the influence. Alcohol and drugs can remain in a person's system for days or weeks. Just because someone may have done something foolish during the weekend does not mean that the worker has forfeited their right to have a legitimate job injury covered by workers compensation. A "failed" drug screen may be grounds for termination, but without some evidence showing that the accident was caused by the worker being under the influence, a failed test alone is not sufficient grounds to deny coverage by workers compensation.
