Claim for Workers Compensation Benefits Turned Down

Claim for Workers Compensation Benefits Turned Down

Claim for Workers Compensation Benefits Turned Down: One of the most common reasons given by workers compensation insurance companies as to why a claim for workers compensation benefits has been turned down is because, according to the adjuster, the injury sustained by the worker was not the result of their on the job accident, but rather was solely caused by some known or unknown preexisting condition.

The majority of times I have spoken with an adjuster who is claiming that they are not responsible for my client's injuries based on some pre-existing condition, the argument ends up being baseless.  This because in Alabama, even if a worker has some pre-existing condition, if it has not prevented the worker from adequately performing their job duties, and the subsequent job injury aggravates or makes said condition worse, then it is now workers compensation's responsibility because in Alabama, the job injury does not have to be the sole, or even main, cause of the injured workers' disability. As long as the job accident was a contributing cause in the worker's disability then it is all considered work related.
