Claim for Workers Compensation Benefits Turned Down

Claim for Workers Compensation Benefits Turned Down

Claim for Workers Compensation Benefits Turned Down: Through the years, our attorneys have spoken with many workers who were under the impression that they were not entitled to Alabama workers compensation benefits because somehow they were at fault in causing the accident which led to their work injury. They are happily surprised when we inform them that, if through an accident inadvertently caused by yourself, you suffered an injury, then you are still entitled to workers' compensation benefits.

Alabama's workers' compensation system is specifically set up to help injured workers get the medical attention they need so they can get back to work as soon as possible. Your employer does not have to be "at fault" in order for you to obtain benefits; if they did, most injured workers would not be entitled to anything as the majority of job injuries are accidents. This is true even if you accidentally did something which led to your injury. The key here is that you inadvertently or accidentally played a part in your injury. If you were involved in horse-play, were under the influence of drugs or alcohol at the time of your injury, you intentionally and with knowledge ignored a safety precaution or intentionally hurt yourself, then you obviously are not entitled to workers comp benefits, but otherwise you are still entitled to all the benefits allowed by law.
