Job Injury Birmingham, AL Comp will not pay for Home Health Care: Fortunately, the vast majority of job injuries are not catastrophic and the worker is able to go forward with their work live; maybe not at the same job they held prior to being hurt at work, but most can continue to work. Unfortunately, there are instances where a worker suffers a serious injury-be in a traumatic brain injury, the development of RSD/CRPS or some other devastating work injury. In those situations, the injured worker may require the assistance of a Home Health Care provider. Such care is expensive, and the workers compensation carrier does not want to pay these bills and a fight over whether they have to pay for home assistance is not uncommon.

In Alabama, the law is clear; the employer must pay for all reasonably necessary medical treatment-including home care. If your treating physician prescribes Home Health Care for you, then it is obvious that they believe it is reasonably necessary, but that doesn't mean that workers comp won't try to get out of it. If at home care has been prescribed, you can rest assured that workers compensation will pay to have another doctor give an opinion as to whether they believe it is reasonably necessary--not surprisingly, most times this doctor says what the insurance carrier wants to hear. However, they do not have the final word on whether they will pay for home treatment--the court does. We have had to go to court on behalf of clients facing this situation in the past, and if the authorized treating physician maintains that home care is needed, then the court generally will order it.

You are not entitled to home care just because you would like to have it; it still has to be ordered by your treating physician.
