Job Injury Birmingham, AL Boss told me to file for Unemployment benefits: I have heard this one many times in the past 21 years I have been practicing in the field of workers' compensation. A worker is hurt at work and they report the injury to their boss as the law requires. Then the employer asks the injured worker to put the medical treatment on their personnel health insurance policy and to file for Unemployment benefits (UE) if their injuries prevent them from returning to work. What should you do?

Don't lie about how you sustained your injury-it could come back to bite you. Also, don't lie to the State of Alabama in order to receive UE benefits--you could end up in jail.

If you were hurt at work, then by law, your employer has to file an injury report and is responsible for paying all your reasonably necessary medical treatment. If your injury prevents you from being able to work, then you are supposed to receive temporary total disability (ttd) benefits from your workers compensation carrier.
