Birmingham Workers Compensation Lawyers Claim Denied: It is not uncommon for a worker to suffer a job injury and report the injury, only to be informed later that the claim was denied. A decent percentage of our clients come to us after their claim was wrongfully denied; so, if your claim for workers compensation benefits was denied, don't give up.

Often the reason for the denial is because the workers compensation adjuster says the job accident was not the cause for the injury; rather, it was caused by an old injury. As we have stated in previous blogs on pre-existing conditions, this defense rarely works. If you were able to work as a normal employee and a job injury aggravates an underlying preexisting condition, then the claim is considered a compensable workers compensation claim. As our courts have stated, workers compensation benefits are not solely for those in perfect health.

We have also had cases where the employer and/or their comp carrier deny liability simply because they don't want to be liable for the injury. In these cases, we hear things like "I don't believe them," or "there were no witnesses." These are not valid reasons to deny liability.

Recently we had a trial in which our client suffered obvious injuries at work and left work to go to the emergency room with the permission of their employer. Later the employer said that they did not believe the accident occurred as claimed by the injured worker because there were not witnesses. In another case we tried, the accident occurred in front of two police officers-one of whom called the ambulance to come and take our client to the emergency room. In that case, the employer-to everyone's dismay-continued to assert that the accident simply did not occur. In both of these cases, proving liability proved to be relatively simple and our clients eventually received the medical care they required-and compensation for their injuries.

Having stated this, establishing liability was possible because our clients did not give up, and they did not attempt to prove their cases on their own. They did what anyone who has had a claim for workers compensation benefits wrongfully denied should do; they hired an experienced workers compensation attorney.
