Huntsville Workers Comp Lawyer Can I use my own doctor: If you have suffered a job injury, you most likely would feel most comfortable seeing your personnel physician. Your family doctor knows you and has a relationship with you; you feel secure that they will do what needs to be done to help you, and if you have been hurt at work, technically, you are free to see whomever you desire (after reporting the injury to your employer), however, your health insurance provider will likely refuse to pay for any treatment which is necessary to treat a job injury as most insurance policies have language which specifically excludes their obligation to pay for the treatment of job injuries since that responsibility lies with the workers compensation insurance carrier. This means that for all practical purposes, you have to see the physician chosen by your employer's workers compensation insurance carrier or risk having to pay back your insurance company all the money they spent for your treatment.

The doctor chosen by the workers compensation insurance carrier is known as your AUTHORIZED TREATING PHYSICIAN, and, per Alabama's Workers' Comp Law, your employer's workers' compensation insurance carrier is responsible for paying all the "reasonably necessary medical and surgical treatment..." prescribed by the authorized treating physician.

Having stated this, what do you do if the comp carrier refuses to pick up liability and send you to a doctor? In this circumstance, you are free to see whomever you wish, but be sure to inform your medical provider of the circumstances which led to your injury and let them know that while the workers compensation insurance carrier is refusing liability, you believe your injury is work related. If later it is shown that your injury was work related, the comp insurance carrier may be forced to not only reimburse your health insurance provider, but they may have to pay for any and all reasonably necessary future treatment the doctor you chose prescribes.
