Huntsville Workers Comp Lawyer Can I use my Health Insurance: It is not uncommon for an injured worker to call our office and ask if they can use their personnel health insurance to pay for their medical treatment. Usually, this question is premised by the statement that the injured workers' employer asked them to put their treatment on the worker's health insurance, with a promise to ensure that the worker will be taken care of. Unfortunately, the employer often fails to carry through.

Your health insurance provider will most likely have language in your policy which specifically states that they are not responsible for paying for workers compensation injuries; that is the responsibility of the workers compensation insurance carrier. If you use your personnel insurance and your provider finds out that the injury was work related, they can (and usually will) pull the money they have paid for treatment, leaving you responsible for paying the medical bills. The workers compensation insurance carrier would be under no responsibility to ensure these bills are paid as you did not see the doctor they chose for you.

More troubling are the instances where the employer not only asks the injured worker to use their health insurance for treatment, but they ask the worker to lie about how the injury was sustained so as to mislead the workers' health insurance provider. In this case, not only does the worker face the possibility of having to reimburse their personal insurance provider for payments rendered, but the lie could serious effect any rights they may have to workers compensation benefits. I could not tell you how many times a worker has said they lied about how he was injured at his boss' request, just to have the lie used against them when the employer suddenly forgets having any knowledge of a work related injury.

Do not lie about how you suffered your job injury, and do not try to mislead your health insurance carrier; it will come back to bite you.
