Huntsville Workers Comp Lawyer Benefits for family of worker killed on the job

Huntsville Workers Comp Lawyer Benefits for family of worker killed on the job: If you have a loved one who dies as the result of an on the job injury, we are sorry for your loss. We understand that no amount of money can ever come close to making up for your loss, but you are entitled to some compensation which can help you and your family with your expenses.

In Alabama, if a workplace accident causes, or is a causative factor, in the death of a worker, and the death occurs within 3 years of the date of the workplace injury (although this date may be stretched longer by payment of disability compensation while the worker was still alive), then dependents of the deceased worker are entitled to certain death benefits. Beneficiaries are those who were totally dependent upon the decedent, or partially dependent upon them for support. Death benefits are payable over 500 weeks absent an agreed to lump sum settlement (if the employer paid compensation for disability benefits prior to death, then the employer is entitled to a credit for monies paid). Moreover, in the event of the death of the injured employee, the employer shall be responsible for paying an amount not exceeding $3,000 toward the burial expenses. This liability is not reduced by reason of private burial insurance carried by the deceased.

Depending on the facts, you may also be able to pursue other legal remedies.
