Birmingham Job Injury Lawyer What Are My Rights Can I see my own doctor: If you have suffered a job injury which requires medical treatment, you are technically free to see whomever you wish, BUT workers compensation does not have to pay for your medical treatment unless you see the doctor they provide you, and your health insurance provider will not pay for treatment which should be paid for by the workers compensation insurance carrier. Therefore, for all practical purposes, you have to see the doctor workers comp tells you to see.

There are certain situations where you can see whomever you wish; that would be in an emergency situation where you cannot wait for authorization from the workers compensation insurance carrier, or in the case where workers comp denies all liability and refuses to send you to a doctor. In the last instance, if it is later proved that you did suffer a compensable job injury, then workers comp will be responsible for paying the medical bills you were forced to incur.

Additionally, when workers comp authorizes you to see a doctor (known as the authorized treating physician), then that doctor is free to refer you to any specialist they choose as long as said referral is reasonably necessary; that specialist then becomes your authorized treating physician.
