Alabama Workers Compensation Repetitive Use Injury

When people think of a job injury, they typically think of someone falling or injuring their back by picking up something heavy, but not all job injuries are acute in nature. Many job injuries arise over time due to over use of a body part. These repetitive use injuries are known as cumulative trauma injuries.

Cumulative trauma injuries (such as Raynaud's syndrome, trigger finger, carpel tunnel syndrome) arise from a worker repetitively and over time doing the same type of motion/movement at work. For such repetitive use injuries, the courts in Alabama have held that the injured worker must prove by clear and convincing evidence that their injury was the result of their job duties, so the burden of proof is higher than for a typical job accident.

Often the symptoms of overuse come on gradually and the injured worker does not really notice anything until one day a stabbing pain shoots through their arm, or they suddenly discover that they have no grip strength when a coffee cup falls from their hands. The gradualness of the injury does not immediate cause the worker to think that their condition may be work related, but if you begin thinking your condition may be work related, speak with your treating physician (it is imperative that one's treating physician knows what your job duties are and how long you have been performing said duties) and immediately report the condition to your employer.
