In Alabama, for an injured worker to have a compensable workers' compensation claim, several hurdles have to be cleared: (1) the injured worker must actually be an employee of the defendant; (2) your employer must be subject to Alabama's workers' compensation laws; (3) you must show that (i) you suffered a job injury (ii) while performing your job duties for your employer; (4) the injured worker has an obligation to inform his employer that he has suffered a work related injury and (5) the injured worker has to show that the injury they are complaining from was the result of the job injury they suffered. If the worker injured in the job accident can show this, then their employer must pay for (a) all of the workers' reasonably necessary medical treatment, (b) reimburse the worker for mileage in driving back and forth for medical treatment or to receive medications; (c) pay the worker 2/3rds of their average weekly wage when off work pursuant to the advice of a physician treating them for their job injuries (until the date they reach maximum medical improvement) and (d) pay compensation to the injured worker for any permanent physical impairment sustained as a result of the job injury.
